§ 1. Definitions
The following terms used in these T&C have the meanings set out below:
1.1 Seller / Adrian — Adrian Kostera Ultra Triathlete, sole proprietorship (ZZP) registered in the Kingdom of the Netherlands, KVK 83562303, VAT/BTW NL003838850B77, with registered office in Sevenum (NL).
1.2 Buyer / Sponsor — a legal person or organisational unit conducting business activity, purchasing a Sponsorship Package for purposes related to that activity. The Agreement is not entered into with consumers (B2B only).
1.3 Project — "1000 Marathons in 1000 Days" — a sports and media undertaking by the Seller consisting of completing 1000 marathons (each of 42 195 metres) in 1000 consecutive calendar days. Scheduled start: 9 September 2026. Scheduled finish: 4 June 2029.
1.4 Sponsorship Package / Package — one of the partnership tiers: Bronze, Silver, Gold, Platinum, or Diamond, described in detail in § 3.
1.5 Project Day — one of the 1000 calendar days of the Project, numbered from D1 (9 September 2026) to D1000 (4 June 2029).
1.6 Price — the amount expressed in euros (€) net, applicable on the date of placing the Order. Euro (€) is the only currency of the Agreement and the only currency of the invoice. The Price does not include VAT, the rate of which depends on the Buyer's country (§ 6).
1.7 Base price — the full price of the Package effective on the day of the Project start (9 September 2026, multiplier 100%). Other prices are expressed as a percentage of the Base price.
1.8 Order — a binding request from the Buyer to purchase a Package/Packages for specified Project Days, submitted through the form on wybierz-dzien.html, by e-mail, or in any other durable form.
1.9 Confirmation — written (e-mail) confirmation from the Seller that the Order has been accepted, together with a pro-forma invoice or VAT invoice.
1.10 Agreement — the legal relationship arising at the moment the full Price is credited to the Seller's account following the Confirmation, in the form resulting from these T&C, the Order, and the Confirmation.
1.11 Diamond Sponsor — Buyer who purchased the Diamond Package — main partnership with industry exclusivity (§ 8). The duration of the Diamond package depends on the timing of the Agreement: from a full 3 years (before Project start) to shorter periods covering the remaining Project duration (§ 4.6).
§ 2. Parties and scope of the Agreement
2.1 The parties to the Agreement are exclusively the Seller and the Buyer. The Agreement does not create an employment relationship, agency, silent partnership, or any joint venture.
2.2 The T&C apply to all Buyers and form an integral part of every Agreement. Acceptance of the T&C is a necessary condition for entering into the Agreement.
2.3 Any deviations from the T&C (e.g. additional deliverables, individual promotional terms, modification of dates) require written form under penalty of nullity and may be set out in a separate annex to the Agreement.
2.4 The Buyer's general terms of business shall not apply, even if the Seller has not explicitly objected to them.
§ 3. Subject of sale and packages
3.1 The subject of the sale is the Seller's marketing service on the selected Project Day or throughout the entire Project (Diamond), including visibility of the Buyer's brand and a package of promotional activities according to the level of the purchased Package.
3.2 The Seller offers five Packages:
Bronze Package · €500 (base price)
A regular working day in Poland or the Netherlands. Ideal start for smaller companies and individual sponsors.
What you get:
- Logo on the running shirt that day — medium size, visible in all materials,
- "Day X · [Your company]" used as the name of the day in communication,
- One Instagram and Facebook story tile provided by the Sponsor, 24h visibility,
- 2 seconds in highlight reels (sponsor frame in the middle of the daily reel),
- Mention in the live broadcast that day,
- Mini-chapter in the blog — entry named after the Sponsor included in the book to be created from the 1000 blog posts,
- Full day exclusivity — each Project Day is sold to only one B/S/G/P Sponsor (§ 3.3).
Silver Package · €1 000 (base price)
Saturday, Sunday, or public holiday. Higher organic reach during weekend peaks of social media activity.
What you get:
- Everything Bronze offers (logo, day name, story tile, highlight reels, blog),
- Premium weekend exposure — higher reach on the Seller's social media on weekends and holidays,
- Greater chance of media resonance due to higher availability of audience time,
- Full day exclusivity — each Project Day is sold to only one B/S/G/P Sponsor (§ 3.3).
Gold Package · €4 000 (base price)
The Seller travels to the Sponsor's location. The run takes place in the city, route, and time indicated by the Sponsor.
What you get:
- Everything Bronze offers,
- Run in the location chosen by the Sponsor — Sponsor selects city, area, start and finish route,
- Route planned together with the Sponsor,
- Open invitation for runners — Sponsor's employees, clients, and local community may join free of charge,
- 3 live broadcasts that day — before, during, and after the run,
- Possibility of placing the Sponsor's branding materials at the location (rollups, banners supplied by the Sponsor),
- Daily highlight reel from the run at the Sponsor's location,
- Full day exclusivity — each Project Day is sold to only one B/S/G/P Sponsor (§ 3.3).
Platinum Package · €8 000 (base price)
Gold + 4 hours of accompanying activities. Meetings, interviews, talks. A full day of the Seller with the Sponsor's company.
What you get:
- Everything Gold offers,
- 4 hours of accompanying activity at a location near the run,
- Meetings with Sponsor's employees (Q&A, discussion, inspiration for the team),
- Interviews with media invited by the Sponsor and internal communication for the company,
- Talks / presentations for Sponsor's employees, clients, partners,
- Photo / video session with the Sponsor's team — ready content for use in the company's communication,
- Full day exclusivity — each Project Day is sold to only one B/S/G/P Sponsor (§ 3.3).
Diamond Package · €75 000 / year (base price)
Full main partnership of the Project (3 full years before start, shorter periods during the Project — § 4.6 and § 4.7). The deepest integration with the project from the first to the last day. Maximum 4 companies from 4 different industry categories.
What you get (full 3-year pre-start package):
- Logo on the running shirt of each of the 1000 Project Days,
- Logo on bib numbers for all runners participating in the Project,
- Logo in the intro and outro of every daily reel (1000 reels × FB, IG, TikTok and other channels),
- Logo in the background of the Project website and the Seller's social media materials,
- 15 Bronze + 4 Silver + 1 Gold days in each of 3 years — total 60 selected Project Days (excluding Special Days § 4.3),
- Day 1 (project start) and Day 1000 (finale) — reserved exclusively for Diamond Sponsors,
- Minimum 10 natural references to the Sponsor's brand on the Seller's social media each month,
- Logo on the Seller's polo shirt during interviews (provided the given medium does not prohibit branding),
- Special dedication in the book of blog entries after the Project ends,
- Full industry exclusivity throughout the Project (§ 8),
- Priority in the Seller's media communication.
For Diamond packages concluded during the Project, the number of days and deliverables is proportionally reduced according to the remaining time (§ 4.6, § 4.8).
Diamond partnership year periods:
- Year 1: 9 September 2026 — 8 September 2027
- Year 2: 9 September 2027 — 8 September 2028
- Year 3: 9 September 2028 — 9 September 2029 (also covers the media buzz period after the sports part of the Project ending 4 June 2029)
3.3. "One Sponsor per Day" rule
3.3.1 Each Project Day may be sold to only one Sponsor under the Bronze, Silver, Gold, or Platinum Packages. Upon payment crediting for a given Day, the Day is removed from the offer and cannot be resold to another Sponsor in any of the B/S/G/P packages.
3.3.2 Practical consequence: each Sponsor obtains full day exclusivity — including industry exclusivity — without the need for separate negotiation of this clause. No other B/S/G/P Sponsor will appear on that Day, regardless of industry.
3.3.3 The exception to this rule are Diamond Sponsors (§ 8), who have permanent branding presence on every Project Day (logo on shirt, in reel intro/outro, on the website, and other fixed elements). The presence of a Diamond Sponsor does not constitute a breach of the B/S/G/P Sponsor's exclusivity, as Diamond represents a different partnership model (Main Project Sponsor), and a maximum of 4 Diamond companies operate in non-overlapping industry categories.
3.3.4 If a B/S/G/P Sponsor finds themselves in an industry conflict with any active Diamond Sponsor, the Diamond priority clause applies (§ 8) — the Sponsor is withdrawn from the Project with a full refund.
3.3.5 Project Days D1 (start, 9 September 2026) and D1000 (finale, 4 June 2029) are reserved exclusively for Diamond Sponsors and are not available for sale in B/S/G/P packages.
§ 4. Pricing and price mechanics
4.1 The Price of each Package is derived from the Base Price and two modifiers: the time multiplier (depending on the Order date) and the Special Day premium (depending on the specific Project Day).

4.3. Special Day premium
Certain Project Days carry an additional percentage premium added to the Price:

4.4 The final Price is calculated as follows: Base Price × time multiplier × (1 + Special Day premium).
4.5 The Price effective on the date the Order is placed is the Price of the Agreement. Changes to multipliers at a later period do not affect the Price of already-purchased Project Days.
4.6. Diamond package pricing mechanics
The Diamond Package has its own pricing mechanics, depending on the timing of its conclusion relative to the Project schedule:

4.7 "Remaining time" means the period from the date of the Diamond agreement conclusion to 9 September 2029, expressed in years (with monthly precision). The date 9 September 2029 is the formal end date of the full 3-year Diamond package — it also covers the media buzz period after the sports part of the Project ending 4 June 2029. The percentage multiplier corresponds to the year in which the Diamond agreement is concluded, not the year in which individual Days take place.
4.8 The number of days covered by the Diamond package concluded during the Project is proportional to the remaining Project time (50 days for the full 3-year package; proportionally fewer for shorter periods).
§ 5. Order and Confirmation procedure
5.1 The Buyer places an Order via:
- the form on adriankostera.com/1000/wybierz-dzien.html, which generates an e-mail message with the list of selected Project Days and Buyer's details, or
- an e-mail directly to 1000@adriankostera.com specifying the list of Days, Packages, and company billing data.
5.2 The Order does not constitute a reservation or Agreement until the Buyer receives written Confirmation from the Seller. Availability of Project Days is on a first-come, first-served basis.
5.3 The Seller will process Orders within 7 working days. In the Confirmation, the Seller may:
- accept the Order in full and issue an invoice,
- accept the Order in part (e.g. some Days no longer available) and propose alternative Days,
- refuse to enter into the Agreement in whole or in part, including for the reasons set out in § 9.
5.4 The Agreement is concluded upon crediting the full Price to the Seller's account in accordance with the issued invoice. Until then, the Project Days indicated in the Confirmation remain provisionally reserved (hold) for 14 days; upon their ineffective expiry, the reservation lapses and the Days return to the offer.
§ 6. Payment and VAT
6.1 Payment term: 14 calendar days from the invoice date. Payment exclusively by bank transfer to the account indicated on the invoice.
6.2 Form of payment: 100% of the Price payable in advance, in a single payment. The Seller does not offer instalment or deposit payments — this is reflected in the pricing mechanics, which include significant discounts for earlier purchase (§ 4.2).
6.3 Failure to pay the invoice within the deadline results in automatic expiry of the Confirmation and reservation of Project Days, without need for additional reminders. The Seller may issue a payment demand with statutory interest under Dutch law (Wettelijke handelsrente).
6.4. Value Added Tax
All Prices in the T&C and on the website are expressed net, excluding VAT. The VAT rate depends on the Buyer's country:

6.5 Buyers from the EU (outside the Netherlands) are required to provide a valid VAT ID (EU VAT number) verifiable in the VIES system. Absence of a valid number results in the application of the Dutch 21% rate.
6.6 The invoice is issued in euros (EUR). The Seller does not provide values in other currencies — the Buyer is responsible for any conversions.
§ 7. Seller's deliverables
7.1 In exchange for payment, the Seller undertakes to provide the deliverables specified for the given Package (§ 3) in a professional, timely manner and to the best of their knowledge.
7.2 Deliverables include, among others:
- physical completion of the marathon (42 195 m) on the given Project Day, in the time window 00:00–23:59 local time of the run location, while maintaining continuity of effort,
- placement of the Buyer's logo as described for the Package (Annex 1),
- publications on the Seller's social media,
- for Gold, Platinum, and Diamond Packages — additional deliverables such as live broadcasts, runs at the Sponsor's location, photo/video materials.
7.2.1. Distribution channels
The Seller maintains and uses the following social media channels for delivery of services:
- Facebook: facebook.com/100Ironmans100days
- Instagram (main, Polish): instagram.com/kostera_ultratri
- TikTok: tiktok.com/@adrian.kostera
- Additional Instagram profiles maintained in other languages (incl. English, Dutch, Spanish, German) — full list available on the Seller's main website.
The Seller reserves the right to add, modify, or close individual channels during the Project — provided that the full scope of deliverables is preserved through the remaining or newly opened channels.
7.3 The Seller does not guarantee marketing results such as number of views, reach, conversion, or growth of brand recognition. Deliverables are provided on a best-effort basis using the Seller's existing distribution channels. The Seller provides publication statistics upon the Buyer's request.
7.4 In the event a specific daily deliverable cannot be performed due to technical circumstances (e.g. lack of internet at the run location preventing live broadcast), the Seller is obliged to replace it with an equivalent (e.g. a published post-factum coverage) within 72 hours of when the deliverable was to take place. This does not entitle the Buyer to a partial refund of the Price.
7.5 The Seller may refrain from completing the marathon on a given Project Day exclusively for health reasons confirmed by a medical certificate, due to force majeure (§ 13), or where completion would pose a threat to the health or life of third parties. Consequences are regulated in § 10.
7.6. Commitment to the highest standard of care
7.6.1 The Seller commits to making maximum efforts to complete the Project in its full scope of 1000 Project Days, and that the only circumstances that may interrupt the Project shall be those set out in § 10.1 (interruption due to health reasons confirmed by medical certificate) or § 10.2 (interruption due to force majeure).
7.6.2 The Seller declares that they do not intend to make use of the voluntary Project interruption set out in § 10.3, and will take all reasonable steps to prevent such a scenario — including health care, regular check-ups, professional medical, physiotherapy, and psychological support, nutrition plan, and preparation of the organisational infrastructure enabling completion of the Project in its full scope.
7.6.3 This commitment is an obligation of best efforts (verbintenis tot inspanning under Dutch law), not an obligation of result — the circumstances set out in § 10.1 and § 10.2 may occur regardless of the Seller's care.
7.7. Seller's communication channels
7.7.1 The Seller's marketing deliverables are provided through the following social media channels, which constitute the primary distribution of Project content:
- Facebook: facebook.com/100Ironmans100days
- Instagram (main): instagram.com/kostera_ultratri
- TikTok: tiktok.com/@adrian.kostera
- Instagram in foreign languages: three separate profiles maintained in English, German and Spanish (links available on the Project website and in Annex 1).
7.7.2 During the course of the Project, the Seller may open new communication channels or discontinue existing ones, guided by the Project's marketing objectives. A change or addition of channels does not affect the obligations under the Agreement, provided that the total reach remains comparable or greater.
7.7.3 The Seller also operates the Project website: adriankostera.com/1000/ and a daily blog with reports from each Project Day.
§ 8. Diamond priority clause
8.1 Upon conclusion of the Diamond Agreement, the Seller analyses the active Agreements of Bronze, Silver, Gold, or Platinum Packages for industry conflict with the Diamond Sponsor.
8.2 Definition of industry conflict: a conflict exists when the activity of the lower-tier Sponsor constitutes clear market competition to the Diamond Sponsor. The decision on the existence of a conflict is made by the Seller in good faith, having regard to the nature of both entities' activities, their market positioning, and the perception of marketing communication recipients. The Seller's decision may be justified in writing upon the request of the withdrawn Sponsor.
8.3 Withdrawal procedure:
- The Seller notifies the withdrawn Sponsor in writing (e-mail) of withdrawal from the Project within 14 days of the conclusion of the Diamond Agreement.
- The notification includes: identity of the Diamond Sponsor, justification of the industry conflict, and information on the refund of 100% of the nominal amount paid.
- The Seller refunds the full Price paid (nominally, without indexation — § 11) within 14 days of the date of notification, to the same account from which payment was made.
- Upon execution of the refund, the withdrawn Sponsor's Agreement expires and the Project Days return to the Seller's offer.
8.4 The Sponsor is withdrawn regardless of their will — this clause does not entitle the withdrawn Sponsor to refuse or to remain in the Project against the Seller's decision. Acceptance of these T&C includes acceptance of the mechanism described in § 8.
8.5 Withdrawal under § 8 does not give rise to the Seller's compensation liability beyond the refund of the Price. The withdrawn Sponsor acquires no claims for lost profits, campaign value, or any other titles.
8.6 A Diamond Sponsor may appear at any moment of the Project — from the pre-start phase to the last day. The Diamond pricing mechanics (§ 4.6) differentiate the cost depending on the timing of the agreement.
8.7 The maximum number of Diamond Sponsors in the Project is 4 (four). Each Diamond Sponsor represents a different, non-conflicting industry category. The Seller maintains and publishes a list of current Diamond Sponsors.
§ 9. Excluded industries and right to refuse
9.1 The Seller as a matter of principle does not enter into agreements with entities conducting the following activities:
- production, distribution, or sale of traditional tobacco products,
- production, distribution, or sale of e-cigarettes, tobacco heating products, vaping devices, and substances for them,
- production, distribution, or sale of alcohol with a content above 18% by volume,
- activities related to gambling and bookmaking,
- activities related to firearms, ammunition, or accessories therefor (excluding state entities responsible for defence),
- political parties, electoral committees, and related organisations,
- activities related to sexual services (pornography, escort, accompanying agencies),
- multi-level marketing (MLM), pyramid financial schemes, cryptocurrencies of purely speculative nature,
- non-bank "payday loans", parabanks,
- religious organisations, denominations, sects.
9.2 Right of subjective refusal. Regardless of the list in § 9.1, the Seller has the right to refuse to conclude an Agreement or to continue an Agreement already entered into with any Buyer at their own subjective discretion — if they consider that the Buyer's activity, positioning, brand values, or specific market practices are incompatible with the Seller's personal values or the nature of the Project.
9.3 Exercise of the right of refusal requires a written justification delivered to the Buyer within 14 days of the decision. The justification should indicate the specific circumstances or practices of the Buyer constituting the basis of the refusal.
9.4 In the event of refusal to enter into the Agreement (before its conclusion), the Seller has no financial obligations to the potential Buyer. In the event of refusal to continue an already concluded Agreement, the Seller refunds 100% of the nominal Price (§ 10).
9.5 Non-conclusion of an Agreement or its termination under § 9 does not give rise to the Seller's compensation liability beyond any refund of the Price.
§ 10. Project interruption and refunds
10.1. Interruption for health reasons
If the Seller is unable to continue the Project due to injury, illness, or other health circumstances confirmed by a medical certificate preventing completion of the marathon:
- The Seller notifies all active Sponsors within 7 days of the decision,
- For uncompleted Project Days (future) — the Seller refunds 100% of the corresponding share of the nominal Price, within 30 days of the date of notification,
- For completed Project Days (past) — the deliverable is deemed performed, the share of the Price corresponding to those Days is not refunded,
- For the Diamond Package — the refund applies proportionally to the remaining Project time.
10.2. Interruption for force majeure reasons
In the event of force majeure events (§ 13) preventing the Project from continuing, the Seller takes one of two decisions in consultation with the Sponsors:
- Reschedule — postponement of remaining Project Days to a later date (up to 12 months from cessation of force majeure), preserving all rights and obligations of the parties,
- Refund — 100% of the nominal Price for uncompleted Project Days, within 60 days of the decision.
10.3. Voluntary interruption by the Seller
If the Seller withdraws from continuing the Project for reasons other than § 10.1 and § 10.2 (personal decision, change of priorities, etc.):
- The Seller refunds 100% of the nominal Price for uncompleted Project Days within 30 days,
- No additional compensation claims arise on the Sponsors' side beyond the refund of the Price.
10.4. Buyer's lack of right to withdraw
After conclusion of the Agreement (§ 5.4), the Buyer has no right of unilateral withdrawal from the Agreement or right to refund the Price for reasons attributable to them. The Agreement is concluded in B2B trade and is not subject to consumer protection. Exceptions:
- justified non-performance by the Seller due to the Seller's fault,
- assignment of rights to another entity (§ 14).
§ 11. No indexation
11.1 All refunds made by the Seller to the Buyer for any reason (§ 8, § 9, § 10, § 13) are made in nominal value, i.e. exactly in the amount actually paid by the Buyer.
11.2 Refunds are not subject to:
- indexation against consumer price index (inflation),
- indexation against any other macroeconomic indicator,
- statutory or contractual interest,
- conversion to the current market value of the Sponsorship Package,
- increase by lost profits or any other compensation claims.
11.3 The Buyer acknowledges that the time of capital engagement is a cost on their side. The Project pricing mechanics (§ 4) offer significant discounts for earlier purchase, ranging from a few to several tens of percent, which are the sole compensation for this risk. For example:

The Buyer accepts that in the event of a refund, they will receive an identical nominal amount regardless of how much time has elapsed between the payment and the refund, and regardless of how much they saved compared to the price on the day of the event.
11.4 The refund is made in the original payment currency (EUR), to the same bank account from which the payment was made.
§ 12. Image rights and materials
12.1. Use of Buyer's brand by Seller
The Buyer provides the Seller with a logo file in vector format (SVG, AI, EPS) together with a brand guidelines book (or at minimum colour guidelines) within 14 days of conclusion of the Agreement. The Buyer grants the Seller a non-exclusive licence to use the logo and other brand marks exclusively for the purposes of performing deliverables under the Agreement and only during the period of the Agreement and in the archival materials of the Project after its end.
12.2. Use of Seller's image by Buyer
The Buyer obtains the right to use the Seller's image (photographs, video materials) exclusively in the context of promoting the joint partnership under the Project and only during the period of the Agreement and for 24 months after its end. Use of the image outside this context (e.g. in promotion of other products unrelated to the Project, in political materials, in campaigns inconsistent with the values publicly declared by the Seller) requires separate Seller's consent.
12.3. Materials created during the Project
All photographic, video, and text materials created by the Seller during the performance of deliverables remain the Seller's property. Gold, Platinum, and Diamond Packages include a licence to use selected materials by the Buyer according to the Package description (Annex 1).
12.4. No image exclusivity
The Seller may carry out other commercial projects (coaching, books, lectures, partnerships) unrelated to the 1000 Marathons Project. The Sponsor does not acquire exclusivity over the Seller's image beyond the scope of the Project.
§ 13. Liability and force majeure
13.1 The Seller's maximum liability for any cause arising from the Agreement is limited to the amount of the Price paid by the specific Buyer under that Agreement. This limitation does not apply to damages caused intentionally or as a result of the Seller's gross negligence.
13.2 The Seller is not liable for indirect damages, lost profits, loss of reputation, or other non-material damages of the Buyer.
13.3. Force majeure
Force majeure means external events, independent of the Parties, impossible to foresee or prevent, the occurrence of which makes the performance of Agreement obligations impossible or significantly difficult. This includes in particular:
- wars, armed conflicts, acts of terror,
- pandemics, epidemics, and administrative restrictions imposed in connection with them,
- natural disasters (floods, earthquakes, extreme weather conditions preventing safe completion of the marathon in a given location),
- mass failures of energy or telecommunications infrastructure,
- decisions of state authorities preventing the Project.
13.4 The occurrence of force majeure does not release the parties from the Agreement, but entitles them to use the reschedule or refund mechanism under § 10.2.
13.5 The party invoking force majeure is obliged to promptly notify the other party of its occurrence and cessation, and to the extent possible provide evidence.
§ 14. Assignment of rights and obligations
14.1 The Buyer may transfer rights and obligations under the Agreement to another entity (assignment) with the written consent of the Seller, which the Seller will not refuse without a justified reason.
14.2 The entity taking over the Agreement must meet the conditions described in § 9 (no industry exclusion, no conflict with an active Diamond Sponsor, no other subjective obstacles).
14.3 The assignment may involve an administrative fee of up to 5% of the Price of the Packages covered by the assignment, intended to cover verification and material update costs.
14.4 The Seller may transfer their rights and obligations under the Agreement to an entity in which they will remain the key person performing the deliverables (e.g. civil partnership with Agnieszka Kostera, Dutch VOF/BV company) — without Buyer's consent, provided that continuity of all deliverables is preserved.
§ 15. Dispute resolution
15.1 The Parties undertake to resolve all disputes arising from the Agreement primarily through direct negotiations, within 30 days of written notification of the dispute by either Party.
15.2 If no agreement is reached through negotiations, the Parties may use mediation conducted by a mutually accepted mediator.
15.3 If the dispute is not resolved through negotiations or mediation, it shall be subject to the jurisdiction of Dutch courts, competent for the Seller's seat. The exclusively competent court is Rechtbank Limburg, location Roermond.
15.4 The law applicable to the Agreement is the law of the Kingdom of the Netherlands, excluding the Vienna Convention on Contracts for the International Sale of Goods (CISG).
§ 16. Final provisions
16.1 These T&C apply in the version current as of the Order date. The Seller may introduce changes to the T&C with effect only for new Orders. Already concluded Agreements are subject to the version of the T&C from the date of their conclusion.
16.2 If any provision of the T&C is held invalid or unenforceable under mandatory provisions of law, the remaining provisions remain in force. The invalid provision is replaced by the provision closest to the Parties' intention.
16.3 All notifications, declarations, and communications under the T&C may be made by e-mail to the addresses specified in the Agreement. For preservation of written form, documentary form (e-mail with electronic signature or sender confirmation) is sufficient.
16.4 For matters not regulated by the T&C, Dutch law applies, including the Burgerlijk Wetboek.
